Terms & Conditions of Use

The terms“Tour Plan Israel” ”TPI” “we” “us” “our” “website” and/or “service” refers to the registered owner of this website : Tour Plan Israel - Tzukim ST. 257 P.O.Box 14298 Eilat 88100 Israel. The term “you” refers to the visitor of this website.

Your Accenptance

By using our website: tourplanisrael.com and its content, you agree to the terms and conditions, as defined hereinafter. If you do not agree to the terms and conditions in this agreement, than you must not use any of our services and/or products.

Using the website

Condition of your continued use of this site is that you agree not to use this site for any purpose that is unlawful or prohibited by these terms and conditions or by other applicable laws and regulations. You will not use it in a way that may harm / impair its performance, corrupt its content or otherwise reduce the overall functionality of the Website. Your continued use of the site also signifies that you indemnify Tour Plan Israel from any loss or damage or costs in connection with any breach of theses conditions or any other legal obligation by you and your use of, or conduct on the site.

Liability

Tour Plan Israel (“TPI”), as a tour operator purchases transportation, accommodations, package tours and other services from various independent suppliers and vendors that are not subject to its control. TPI CANNOT, THEREFORE, BE LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, OR ANY OTHER SPECIAL, CONSEQUENTIAL or incidental DAMAGES that may occur due to (a) intentional, wrongful, negligent, or arbitrary acts or omissions on the part of a supplier, its employees and others not under the direct control of TPI, or (b) defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers. In addition, TPI cannot be liable for delays in departure or interruption of your vacation arrangements caused by weather conditions, technical problems of any aircraft, vessel, automotive vehicle or other equipment or instrumentality, strikes, war, terrorist activity, civil commotion, or any causes beyond the control of TPI. In no event will TPI be responsible for incidental, consequential or special or incidental damage or loss suffered by any person. TPI’s maximum liability, for any reason whatsoever, will be limited to the amount paid to TPI for its services. In issuing tickets and or vouchers for transportation, accommodation, tours, other activities and services listed in our website, TPI is not acting as principal but only as agent for the suppliers or vendors providing or offering their services and products. To the extent TPI shall not be acting as an agent, as stated above, it shall be deemed to be acting as an agent of the purchasers in arranging or booking tourism services.

Indemnity

You agree to indemnify and hold Tour Plan Israel (“TPI”), and its subsidiaries, affiliates, officers, agents, members, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or make available through the website and its services, your use of the website and its services, your connection to the website and its services, your violation of the terms of service, or your violation of any rights of another.

Age and Responsability

You represent and warrant that you are of sufficient legal age (minimum 18 years) to use this site and to create binding legal obligations for any liability you may incur as a result of the use of this site. You agree to be financially responsible for all of your use of this website. You agree to abide by the terms or conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with all rules and restrictions regarding availability of fares, products, or services. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this Web site. You are in charge of retention of tickets, reservations, tour documents, vouchers, invoice or bookings after issuance of these documents.

Modifications to Service

Tour Plan Israel (“TPI”) reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the website and or its services (or any part thereof) with or without notice. You agree that TPI shall not be liable to you or to any third party for any modification, suspension or discontinuance of its website and or services. We advise users to regularly check the Terms and Conditions of this agreement.

Suppliers, vendors & Service Providers' pages

Throughout this site, Tour Plan Israel (“TPI”) presents SUPPLIERS / SERVICE PROVIDERS / VENDORS / ADVERTISERS pages for your convenience. These pages are submited to TPI by services providers and TPI does not endorse, control or make any representations, warranties or conditions concerning their contents . It is your responsibility to verify any information contained within these pages before relying on it. Also, the information contained in the pages may be changed, updated or cancelled at any time without notice. Various service providers may have their own terms and conditions that you should locate and review. You agree that TPI shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.The information contained with these pages is provided on an "as is" basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any of the components.

2. TOUR PLAN ISRAEL MAKES NO WARRANTY THAT

   (i) THE WEBSITE AND ITS SERVICES WILL MEET YOUR REQUIREMENTS,

   (ii) THE WEBSITE AND ITS SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE,

   (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE WEBSITE AND IT SERVICES WILL BE ACCURATE OR RELIABLE,

   (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE
        WEBSITE WILL MEET YOUR EXPECTATIONS, AND

   (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

Governing Law and Jurisdiction

This Agreement will be governed by the laws of the State of Israel and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of Israel - Tel Aviv Courts without reference to rules governing choice of laws. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed seperable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Privacy Policy

Privacy - Confidentiality
The information you knowingly provide us with and or through forms and e-mail, including any personal details, such as name, address, telephone number etc. will be kept confidential and used to support your customer relationship with TPI.

Information regarding you or your travel purchase will not be given or sold to any outside organization for its use in marketing or solicitation. For our internal purposes, we gather date, time, browser type, navigation history and IP address of all visitors to our site. This information does not contain anything that can identify users personally. We use this information for our internal traffic analysis and system administration, and to gather broad demographic information about our user base for aggregate use. We do not share this information with any third parties.

Registration, Forums & Response sumbmitance

Using TPI’s forums you agree to abide by all of its rules and policies. You agree not to post any material which is vulgar, defamatory, inaccurate, harassing, hateful, threatening, invading of others privacy, sexually oriented, or violates any laws. You also agree that you will not post any copyrighted material of which you are not the owner.

Though you remain solely responsible for the content of your posted messages, TPI reserve the right to reveal information about you in the event of a complaint or legal action arising from any message posted by you.

TPI also reserve the right to delete any message for any or no reason whatsoever. Under Act of 1998 (COPPA) TPI will refrain from collecting information from those under age 13, more so if you are bellow age 13 you are not permitted to use TPI’s forums and or other services.

Some text, graphics and images are used on our website under special permission of their copyright owners and are marked with © and or creditted . All intellectual material such as trademarks, trade names, patents, registered designs remain copyright property of Tour Plan Israel 2007. You will not copy, download, transmit, reproduce, print, or exploite for commercial purpose any material and or intellectual property on this website.

Reservation Policy

Reservations must come in writing either by mail or by fax and must be acknowledged in writing by TPI's operating agent. When reserving services with TPI, unless mentioned otherwise, a 25% deposite is required upon submitance of reservation. Remaining due payment will be fully charged not later than 7 days before star of services.

Payment & Cancellation Policy 

Kindly note that the determination of a tourist in Israel has been changed. Tourist is a person who entered Israel with a foreign passport (passport must be valid minimum 6 months !) and his/ her passport was stamped with Visa class B1, B2 or B3. All other persons entering Israel, including those with dual citizenship, are subject to Value Added Tax (no V.A.T. in Eilat). All of the below terms & conditions apply to tourists only.

The terms specified hereinafter are relevant only when payments are made to Tour Plan Israel ("TPI"). In case you book your services directly with supplier or vendor, their own Terms & Policy will apply.

General

Unless otherwise mentioned or agreed upon, you agree that your credit card will be charged for the full cost of your reservation upon submitting your reservation request. The cost of your reservation is the total of the whole reservation plus an additional amount for our service fees charge in connection with the handling of your reservation.

Our service fee is set on 10% but may vary, based on the total amount of your reservation. In case a reservation is not under Israel's tourist terms (see above in red) you will be charged taxes due. Please note : The suppliers or vendors bill all applicable taxes to us and we remit such taxes directly to the supplier / vendor.

Form of payments

Credit Cards 

• We accept Visa, Mastercard & American Express
• Electonic cards like Visa Electron or A.T.M are not accepted.
• A credit card form should be filled in and sent by fax. Only following Credit Card clearing will your reservation be in effect.
• Unless stated otherwise, your Credit Card will be charged by TPI. You and the supplier will receive a voucher from TPI covering the booked services.
• Your Credit Card will be automatically debited in full 7 days prior to starting of first booked activity, unless otherwise agreed.

Personal Checks

• We accept personal checks. No third party checks. Checks to the order of : "Tour Plan Israel" to be sent by regular post (not registered!) to : Tour Plan Israel, Tzukim St. 257/4, P.O.Box 14298, Eilat, 88100 Israel.
• The banks' check cashing fee (aprox $17) will be added to your total payment sum.
• Only after check clearing will your reservation be in effect.

Bank Transfer

• Our account & bank details will be sent to you by mail or fax upon request.
• All bank transfer fees to be added to your total payment sum. 

Cancellations

• All cancellation of services booked with TPI, must be submitted in writing and vallidated by TPI's operating agent.
• Different suppliers / vendors carry different cancellation policies. It is your responsability to ask & verify it before final confirmation of your reservation, and you agree to pay any cancellation fee and / or change of reservation fee that you incur. TPI will not be held responsible for any of these due fees.
• To furthur understand TPI's liability issue, please read TPI's Terms & Conditions.

Cancellation of Services, Daily Tours & Outdoor Activities

• Unless otherwise stated (in time of reservation), these can be cancelled with no penalties up to 3 full working days (Sunday to Thursday) prior to expected start of services, except for $25 per reservation -administration fees . NOTE : During High Season, Jewish holidays and Christmas / New Year, these services can be cancelled with no penalties up to 7 full working days prior to start of services.
• Cancellations 1 - 2 days prior to star of services carry a 50% refund.
• cancellations 1 day before, no shows and unused services will be fully charged.

Cancellation of online Hotels & Car Rentals reservations

• Online Hotels & Car Rental reservations present their own cancellation policy. Please read Cancellation Policy on our online reservation pages (Policy by our affiliates Eshet Incoming LTD)

Cancellation of Vacation Apartments, Private Tours & Private guides

• Each of the suppliers / vendors carry their own cancellation policy, which will be extended to you upon confirmation of reservation or before if asked for. It is your responsability to ask & verify the payment & cancellation policy, and you agree to pay any cancellation or change of reservation fee that you incur. Cancellation of Groups (15+ participants)

• Groups will receive separate cancellation terms with their quoting proposal.
• You agree to pay any cancellation or change fee that you incur. w You agree to abide by the terms and conditions imposed and or as specified on the reservation order form.
